The application was received on 7/10 and the checks were cashed today - How will you receive the resceipt number ? Would it come in the mail?

USCIS will sent you receipt. If you do internet banking and can see your check, on reverse side of check, they stamp with detailed infromation. If you can access that you can find it.

Yesterday I picked up receipt number for my son from check, who applied OPT/EAD in CSC.

Otherwise wait for few more days to get receipt.

According to some websites more than 8000 I-485 applications were filed on July 2nd. Applications areprocessed according to the receipt date.

As there were thousands of application on July 2nd will time of receipt play any role in processing?

    Just curious.

Please particiapte in our attempts to build the community through constant grassroots efforts. We want every member to feel they are an integral part of IV.

We will be continuing to build our community strong on models of successful organizations like AAPI, AAA, AARP ...... where people get a sense of community.

Very often our community (immigrant) seems to always have divided opinions and views and such things keep us away from being one strong community. When we reach new shores, we must keep everything aside -

"lets all forget that they are Indian we are Chinese" ,
"lets forget that they are Tamil we are Hindi",
lets forget that "they are Reddy and we are Khamma"

    - lets look at what binds us together?

As Skilled workers what do we have in common? Our community is intelligent, hard working, honest and contribute. We are entitled for fair processes. is it Individual entitlement? is it collective?

What can bind us? A common goal and a common drive and common wisdom.

Our efforts this year and moving forward will be towards buliding trust, community, working towards small successes, workingh towards community help and for that we need all your cooperation and help. We need everyone to join hands. Lets all join hands for one IV - One Voice

Hi, I have a quite strange situation here:

I am from China. I have an approved EB2-NIW I-140 with priority date of 2/2008 and an EB1a 140 petition denied on 8/4/2010.

I filed an I-485 concurrently with my EB1a, along with EAD applications. I got my EAD on 11/2009 and used it to work already.

The strange part is, my I-485 case is still pending, even though my EB1a petition is denied. In fact, I received RFE for quality photos two weeks after my 140 was denied. I think this is a USCIS error because they think my 485 was linked to my EB2-NIW case.

Now, am I staying in the U.S. illegally even though technically my 485 petition is still pending?

    Thanks for all you comments.

    hello,
This is a pretty complicated situation. What you should do is to speak to your attorney to "connect" your APPROVED I-140 with currently pending 485 petition. Other than that, as long as your 485 is not DENIED, you remain in period of "Authorized Stay" and all documents issued based on the pending 485 remain valid. Note that EAD and AP are issued based on a pending 485, not based on I140. Still, I highly recommend you speak to a qualified attorney. If you PM me, I can recommend one.

    Good Luck.

Please see below for my answers..

I'm on H4. I have got an offer from a company and they will do my H1

    I have few questions

1)How easy it is to transfer H1's to another company? What documents I need?
You'll have to file a Change of Status application with USCIS. If this is your first time H1-B, then you will be subjected to the cap.

2)Is it possible to convert back to h4? I have 2 kids so I might have to convert back to H4 from h1 if I cannot take the stress.
what documents do I need?Do I need to go out of US for this?
Yes, you can change your status to H4 from H1. You do not need to travel outside of US. You need to show that your spouse is maintaining proper status. You do not need to show your paystubs for this.

3)Once back on H4, and in future If I want to get back on h1, Am I subject to cap?
Since you have already held H1-B status for a non-exempt employer, you are not subjected to the cap

Information on how to read the report
Questions & Answers: Pending Employment-Based Form I-485 Inventory

Q: Why is the wait so long for my employment-based green card?

A: A visa must be available before a person can obtain an employment-based green card. Because more people want a green card than there are visas available, not everyone who wants a green card can get one immediately. Therefore, some people have to wait in line until a visa is available. The U.S. Department of State (DOS) gives out 140,000 employment-based visas each year. About 85% of those visas go to people seeking a green card in the United States, while about 15% go to people seeking to immigrate from abroad. Currently, about 234,000 people have employment-based adjustment of status (green card) applications pending in the United States and are waiting to get a visa. How long you wait for a visa depends on the supply and demand for your particular preference category, your priority date, and the country your visa will be charged to, usually your country of birth.

Q: How can I determine my place in line based on my priority date?

A: Your preference category, priority date, and country of origin determine your place in line for a visa. The earlier your priority date is, the closer you are to the front of the line. To better assist you in knowing your place in line, we are posting a report of our total pending inventory of applications for employment-based green cards (Form I-485, Application to Register Permanent Residence or Adjust Status) for those seeking to adjust status in the United States. See the Pending Employment-Based Form I-485 Report link to the right. We are also posting five other reports by country of chargeability (China, India, Mexico, Philippines, and All Other Chargeability) (see the links to the right).

The Pending Employment-Based Form I-485 Report, displays the total number of pending adjustment of status applications, per preference classification. The report shows how many pending adjustment of status (green card) applications in each preference classification have priority dates in a given month and year. You can use this chart to determine how many applicants in your preference classification have priority dates in the same month and year as your own. Also, you can determine how many applicants in your preference classification are ahead of you in line for a visa number by adding together the number of cases with an earlier priority date than your own.

The All Other Chargeability report shows how many applicants from countries other than China, India, Mexico, and the Philippines have priority dates in a given month and year. The report is broken down into separate charts for each preference classification. If you are from a country other than China, India, Mexico, or the Philippines, you can use this chart to determine how many applicants for adjustment of status in the same preference classification have a priority date in the same month and year as your own. This chart also lets you know how many applicants in the same preference classification have earlier priority dates.

Because of historically higher demand for visas from China, India, Mexico, and the Philippines, each of those countries has its own separate report. As published in the DOS Visa Bulletin, applicants from those countries will need to have earlier priority dates than like applicants from other countries to get a visa in any given month. If you are from China, India, Mexico, or the Philippines, you may want to use the report for your particular country. Your country report will show you how many applicants from the same country and preference classification have a priority date in the same month and year as your own. The report will also let you know how many applicants from the same country and preference classification have earlier priority dates.

Q: Which report should I use, the Pending Employment-Based Form I-485 Report or the country-specific reports?

A: All applicants for an employment-based green card may use the pending Form I-485 report to determine their place in line for a visa. Because certain countries experience higher demand than others, applicants in these oversubscribed countries may move forward in line more slowly than applicants in countries experiencing less demand. In other words, in order to obtain a visa, applicants in oversubscribed countries may need to have earlier priority dates than applicants in countries experiencing less demand. Applicants in oversubscribed countries may therefore want to also refer to the report for their specific country of chargeability to determine where they stand in line with other applicants from that country.

Q: What information do I need to have before using the pending Form I-485 inventory reports?

A: You need to know your priority date and your preference category to use the pending Form I-485 inventory reports. For more information on priority dates and preference categories, see the Visa Availability & Priority Dates and Green Card Eligibility links to the right.

Q: How do I read the pending I-485 inventory reports?

A: First, click on the link to the report you want to view. Once you click on the link, the report will appear and you will see a series of charts, one for each preference category. You will see that each chart has different numbers for each month and year. These numbers show how many green card applicants have priority dates in that month and year. To figure out how many applicants have earlier priority dates, add all the numbers from all the cells that correspond to earlier months.

Q: Can you tell me when I will get a visa?

A: Unfortunately, we cannot determine how long it will take for you to get a visa. However, we hope that by showing applicants with a pending Form I-485 where they stand in line to get a visa, you will get a better sense of how long it may take. We intend to update the data in these reports quarterly. By comparing newer versions of the reports with older ones, you may see that the number of applicants ahead of you has gotten smaller, and you may be able to tell how much shorter the line has become. We hope this will give you an even better sense of how long it may take for you to get a visa.

Q: Can you provide me an example of how to use the pending Form I-485 inventory charts?

A: Assume your priority date is in January 2007, your petition was approved for third preference, and you are from China. Using the Sample Pending Employment-Based Form I-485 Report, below you will see on the third preference chart that there are 2,618 applicants with a priority date in the same month and year as your priority date.

If you want to find out how many third-preference green card applicants have an earlier priority date than yours, you will need to add all the numbers starting with the number at the beginning of the table, January 1997, and ending with the number immediately before the month and year of your own priority date, December 2006. You will see that there are 131,341 third-preference applicants who have a priority date earlier than yours.

Q: How do I know how many applicants from my country have an earlier priority date than mine?

A: Assume your priority date is in June 2005, your petition was approved for third preference, and you are from India. Using the Sample I-485 Inventory for Individuals Born in India Report below, you will see that there are 175 green card applicants from India with a priority date in June 2005.

To find out how many applicants born in India have an earlier priority date than yours, add all the numbers starting at January 1997 and ending at May 2005. You will see that there are 42,796 third-preference applicants from India with a priority date earlier than yours.

ok..from what I have been hearing from my multiple friends and company's attorneys, USCIS has been digging deep into most of the 485s..

Our company guy said, there is some new policy in 485 processing which is causing them to gather lot of other information (I havent seen this policy published anywhere..so thought this guy is bluffing)..but I dont know many ppl have been saying about such RFEs or RFEs which were not raised before are more common now.

Look at my other thread as an example.

    Hopefully you resolve it fast

Yes, you're right, Berkeleybee, that no restriction on AC-21 job portability contradicts labor certification stage. But isn't it also true we can change our job to whatever we want once we get GC? Due to the false system, if we lost years waiting in line, why can't they change the rule to make up for it? I think it is a legitimate and justifiable demand.

I don't understand why are you raising this issue in a forum specifically designed to address immigration issues.

If you need to find a good desi consulting company then you would have to do your own research. After all what would you expect from the members...company A is good and company B is bad!

You are not going to get a definite answer from this forum! Also, please understand that there are many members here that may not work for desi consulting companies or are desis for that matter. Do your own research and find a company that works for you without soliciting opinions from a forum not designed for such responses!

    My humble 2 cents!

FYI: Ours went to R Williams on July 2nd/NSC and there is thread on this forum if you are interested. We heard nothing. According to the posts, if any of R Williams cases had any action, they happened at other service centers. You person might be sending the submittals around as well if they were received on July 2nd. Hang in there

This is clearly a case of pharma companies wanting to make more money. My question is, why target only immigrants? There is something fishy here. I dont buy their argument. Fuck the green card. I'm not putting my wife through this shit. The sad part is that everything is commercialized in USA. Dont bring it upon your health. A slew of medicines have been pulled off the shelf and for heavens sake, this is a vaccine. I'm not scaring anybody.

My girlfriend is an Australian citizen and I am an Indian citizen.

Her uncle and cousins immigrated to the US years ago and she seems to have a Family-Based Immigrant VISA under category F4.

    Her parents have greencards too.

She believes her greencard was filed for her by her uncle after he got his US Citizenship.

    1. Can this be the case? ( Can an uncle file a green card for a niece? Or was it filed by the cousins? )

We were recently browsing the USCIS site and it seems she still has to maintain continious residence in the US for 3 more years to be eligible for naturalization.

    2. Is it mandatory for green card holders to have 5 years in the US to be eligible for naturalization regardless from the country they are from?

I mean, a lot of immigrants come from India, China etc, but applications from Australia are a lot less.

Will she, being an Australian citizen, have to wait for 5 years just like immigrants from India, China etc have to? Or can she wait in the US for less time?

    3. We would love to get married soon. I don't have any immigrant or dual intent VISAs for the US nor am I very much interested in going to the US either.

However, her uncle has told her that her greencard would be revoked if she got married to me before getting her US Citizenship.

Is this just empty an threat from her uncle or are there really restrictions on how person with a greencard can get married or not?

    4. Are not all greencards created equal?

    5. Is there any way by which we can verify, by ourselves, what is the category and type of greencard she has?

    Any special serial numbers/markings/etc?

I would love to have contacts of good immigration attorneys either in Hyderabad, India or San Francisco, US in case this case is complicated.
